18-year-old charged with terroristic threats in Sarpy County after Instagram comment

An Omaha teen is in jail on a $10 million bond after allegedly making a threat in an Instagram comment in early October.

Marshall Fry, 18, was charged with making terroristic threats and arrested Oct. 22 in Sarpy County.

An affidavit from the Sarpy County Sheriff’s Office stated that the Instagram account “marshall506861” posted the comment, “Finna shoot you guys up,” on a post from Scary Acres, a seasonal haunted house attraction.

Michael Halbleib, Scary Acres’ head of security and a former Omaha police officer, reported the comment to the Sheriff's Office on Oct. 6.

Following the report, Investigative Sgt. Matt Barrall said the Sheriff’s Office issued a search warrant for the account to Meta, which provided an ISP address, phone number and birthdate that linked the account to Fry. The sergeant said Fry’s search history revealed alarming results.

“His search history showed, quite a fascination with responses to shootings, responses to mass casualty events, and how to defeat what a law enforcement response would be,” Barrall said.

The Sheriff’s Office said the account had no followers, posts or tagged posts. The account followed 30 accounts, some promoting antisemitism, white supremacy, and photos and videos of animal torture. One account “marshall506861” followed, called “bloodyshootings,” contained uncensored videos of shootings.

Barrall emphasized that online threats should never be ignored and that people should report anything suspicious. He said as public discourse moves online, the rules about what constitutes a threat have not changed.

“Those threats are taken seriously," he said. “Those are taken seriously both by law enforcement and the courts as the same as if you heard it on the street.”

According to Nebraska court records, Fry received a disorderly conduct citation as a minor for an incident occurring on March 27, 2025, in Sarpy County. Fry was sentenced to 13 months of probation starting in August.

Fry was originally charged with third-degree assault for the incident, which occurred in Douglas County and involved a female victim. The charge was later amended to disorderly conduct and the case was moved to Sarpy County.

According to the Sarpy County affidavit, a Sheriff’s Office investigator stated Fry had been previously hospitalized several times for suicidal and homicidal ideation. Firearms belonging to Fry’s father are present in the home, though the affidavit states probation officers were unsure if Fry had access to them.

Fry’s father denied in an interview with the Omaha World-Herald that Fry had access to guns. The father, who was not named, also said Fry has no driver’s license and had no way to get to Scary Acres. He called the Instagram post an “emotional outburst” and nothing more.

Fry’s preliminary hearing is set for Nov. 17.
